Opinion for My order was not delivered after payment was made to the supplier

After ordering and paying 50% in advance, supplier claimed he is having problems with manufacturing and offered to change the original order to different material. We asked if he is going to supply or not and he ignored this question, therefore we immedietly cancelled our order and demanded a refund. We did not recieve any refund and now he claims that because we cancelled the order the money stays with him.
