Feedback to TradeKey from U.S. customer – Adam Rosenbloom The name of the person I dealt with was Yang Feng of the OK Crystal Factory in Yiwu, China. Payment was made for a crystal chandelier in the amont of $273.00 plus and additional $118.00 shipping charges on Dec. 12. 2008. When the chandelier arrived three pieces were broken. The company created a replacement part for one of the pieces, but this part was not created correctly. It was nearly twice as large as it should have been. The company has offered to ship me a new chandelier, but only on the condition that I pay for the shipping charges again. Mr. Muhammad Ali Samejo of Tradekey informs me that it is in fact the seller’s responsibility to make sure I receive the items in 100% excellent condition with no defects/damages, and that it is against the law to back-track on this agreement. So I am currently left with a broken chandelier at home and the company is refusing to issue me a refund of the purchase price. Now, I simply want a refund of the $273.00 I paid for the chandelier. When I tried to send it using the business form the lady at Western Union said that the business code 322000 was not coming up on their computer. So, as per your instructions, I used the residence form instead. The lady at the New York office said that since I was sending the money to a residence, you are going to have to pick up the money at a Western Union office in China. They will call you on the 579-85525892 telephone number to let you know that the money has arrived. If you don’t know the nearest office location, ask them. Furthermore, I was not notified that there was any statute of limitation as to when your company can file a claim for reimbursement. You can also submit the dated records of our correspondences to the Express Company if there are any questions as to the truth of my statement the chandelier arrived damaged The reason the time is long past is because I was waiting for you to create a new siphon. The new siphon was created much too large. Therefore, the fact that my super didn’t discover the additional broken pieces until later is not relevant. I certainly think it appropriate for your company to at least submit a claim to the Express Company and see what happens. At the heart of the matter is the fact that the chandelier was not packaged properly as it should have been, with a wooden crate and good packing material. I had even asked before and you sent me a photo of the crate and wooden batten and it was not packed that way. Had it been, this whole situation could have been avoided. If you wish, I will pack up the chandelier as best I can and send it back to you, at your expense, however. I paid for the international shipping once. To have me do so again, seems quite unfair. I’m sure we both want to avoid a costly legal proceeding. Your company really does such fine work. But I cannot pay twice for the shipping when it is not my fault that the chandelier broke. If something like that happens here in America the company always pays for it. They automatically send a return label, just in case. In fact, that just happened to me with a large book case from California. It arrived with a hole in it and the company paid for the return shipping. No questions asked. I think the truly honorable thing to do would be for you to simply send me a new chandelier at your expense, packed properly this time. I will be happy to write a letter to the Express Company in support of your claim for reimbursement. Again, if there is any Consumer Protection Agency in China as we have here in America I will also write a letter to them praising your fine customer service. Jennifer, would be possible to give me a new chandelier without returning the all remaining parts of the old one? Normally, I wouldn’t make such a request. But I am only a customer. I am not set up for shipping a chandelier to China. It means I have to find a store that sells a proper crate, and packing materials. Then I will have to go and purchase the materials. Then I will need to wrap each individual piece of the chandelier by hand and seal the crate. But it will take me an entire day of my life and I cannot afford to spend an entire day involved sending a broken chandelier back to China. It would really be a tremendous hardship. On the other hand, the parts could still be of value in the construction of a new chandelier for you. I understand that and I want to minimize your loss. I propose to you, therefore, that I will buy a new sturdy box, and packing material. I will ship to you the less breakable parts of the chandelier, namely all the separable parts made out of brass and other metal. The delicate crystal tubing, however, I believe, is best left in the USA. When I think that in this case, even experienced professional packaging companies such as yourselves, could not deliver all the crystal undamaged, the chances for an amateur packer such as myself doing so successfully seem rather unlikely. Look how GIGANTIC the new one is! It didn’t even fit on the scanner bed, while you can see that the old one did. That’s why I was laughing. Also, see, there are supposed to be wires inside. But we will find a way to make this work anyway, I’m sure. I was finally ably to speak with the superintendent of my apartment building today. There is good news. The glass siphon which arrived by DHL was completely undamaged. It was extremely well packed. Absolutely no breakage. Now, the old glass siphon came with a piece of black plastic and silver metal strips on one side. There were also two white wires enclosed inside the glass siphon. There was a brass nut and some threading as well. The new siphon only came with the glass part and the two brass ends. No black plastic, no silver strips, no white wires, no brass nut, and no threading. Most importantly, the piece is far too large to be a part of the chandelier. It is not at all the same size as the other five. By comparison it is a GIANT! (LOL) I took a piece of plain string and laid it alongside the glass siphon. Then I measured the length of the string. It was 24 inches long! It was supposed to have been 14.6! What happened?! I am laughing. So I just don’t see how it can possibly be used. ---- To make matters even worse, my apartment building superintendent did not inspect all the pieces in the package thoroughly. He said that glass siphon was the only piece that was damaged, but that was not true. Today I opened the entire package for myself and unwrapped and examined every piece with my own eyes. There were two additional pieces that were damaged 1) a small red dome-like object (one of a set of six) and 2) a large red dome-like object. I can put the pieces of the chandelier on my scanner if you need verification of this. I have also saved the original box as proof of the substandard packaging the first time. ---- Jennifer, I am certainly open to any suggestion you may have as to how to resolve this matter. The more I spend time with this chandelier, the more I love it. I don’t want any other. I can walk down the street in my own town and buy a chandelier. But it wouldn’t be the same. I am willing to go to the trouble to have it imported from China. At this point, I really think the easiest thing to do would be for you to send me a brand new chandelier and package it really well this time, with the same attention to detail with which your company packed that last DHL package. I think that would better than trying to manufacture three small separate little pieces which might not fit together. I would also like to add that I feel that we here in America are not totally blameless in this matter. If my building superintendent had not told me that the glass siphon was the only piece of the chandelier that was damaged your company might have made a different decision. If he had told me the truth, namely, that three pieces were damaged, your company might have come up with different solution and spared you the trouble and expense of creating the new siphon (never mind that it was too big). Therefore, while I think it is best that I receive a brand new chandelier, this time I wish to offer to pay for the full cost of the shipping. I hope you think this is fair. If you do that I would be happy to write a letter to your company’s Customer Care Department thanking the department for its commitment to the highest standards of customer satisfaction.
